2. The petitioner seeks bail in connection with Chautham P.S. Case No. 406 of 2023 registered for the offence under Sections 376D, 307 of the Indian Penal Code and under Section 27 of the Arms Act.

3. Initially an FIR for rape with attempt to murder has been registered against the petitioner but the police, after investigation has found the case false under Section 376 and submitted charge-sheet under Section 307 of the Indian Penal Code.

4. The petitioner is in custody since 2.12.2023.

5. It has been submitted by the learned senior counsel for the petitioner that because of an earlier murder case, the petitioner and other accused persons have falsely been implicated in this case.

6. Learned counsel for the informant has vehemently opposed the application of the petitioner for grant of bail.

7. Considering the aforesaid facts, this application is allowed.

8. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class, Khagaria in connection with Chautham P.S.
