The petitioner seeks bail in connection with Sessions Trial No.383/2018 arising out of Minapur P.S. Case No.322 of 2017, registered for the offence punishable under Section 302 of the Indian Penal Code.

Earlier, the bail application of the petitioner was dismissed vide Cr. Misc.51897/2019 on 02.03.2019 by a coordinate bench of this court with a direction to the trial court to expedite the trial and try to conclude it within six months. Vide order dated 06.08.2021 passed in the instant bail application of the petitioner, a report was called for from the court of Learned Sessions Judge, Muzaffarpur, regarding the stage of trial.

In compliance thereof, a report dated 17.08.2021, kept at

Patna High Court CR. MISC. No.19891 of 2021(3) dt.25-10-2021 2/2 Flag 'R' has been sent by learned Sessions Judge, Muzaffarpur, whereby it has been submitted that out of eight witnesses cited in the chargesheet, three witnesses have already been examined. Last witness was examined on 25.11.2019, rest witnesses are yet to be examined.

Considering the submissions made through the report, I am not inclined to grant bail to the petitioner named above. The prayer for bail is hereby rejected.

However, learned trial court is directed to conclude the trial as expeditiously as possible, preferably within a period of nine months from the date of production of a copy of this order. The S.S.P, Muzaffarpur is directed to take steps for production of the prosecution witnesses for their examination as and when the date is fixed by the trial court, so that the trial may be concluded within the time indicated herein above.
