JUSTICE PRABHAT KUMAR JHA ORAL ORDER 27-05-2020 Heard learned counsel for the petitioner, learned counsel for the State and the learned counsel appearing on behalf of the Nagar Parishad, Buxar as well as Mr. Prashant Sinha, learned counsel appearing on behalf of the respondent No.8 and 9 through Video Conferencing.
The petitioner filed this writ petition for a direction to the respondent-the Chief Executive Officer, Nagar Parishad, Buxar for payment of all the retiral benefits to the petitioner.
Patna High Court CWJC No.16532 of 2017(3) dt.27-05-2020 2/2 Learned counsel for the Regional Provident Fund Directorate submits that Regional Provident Fund Directorate is not the necessary party. The payment is to be made by Nagar Parishad, Buxar.
With the consent of the parties, I dispose of this writ petition with a direction to the Chief Executive Officer, Nagar Parishad, Buxar to pay all the admitted retiral dues of the petitioner within four months from the date of receipt of this order otherwise serious view will be taken as the petitioner retired in the year 2012 and according to her, no retiral dues has been given to the petitioner.
With the aforesaid direction, this writ petition is disposed of.
