Petitioner is not named in the first information report and his name came in this case after 18 days of institution of the first information report on the basis of protest petition filed on behalf of the informant.

Although, learned court below has referred several paragraphs of the case diary to show the involvement of the petitioner in the alleged crime but in course of hearing, it is admitted, on behalf of the informant that none has seen the actual killing of the deceased and only material against the petitioner is that he was also present at the time of alleged occurrence.

Patna High Court Cr.Misc. No.2731 of 2015 (3) dt.02-02-2015 2/2 Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate,Barh, Patna in connection with Athmal Gola P.S.Case No. 172 of 2012.
