Petitioner seeks bail in Pakridayal P.S. Case No. 121 of 2016 registered for the offence punishable under Sections 147, 148, 149, 302, 307, 120 (B) and 34 of the Indian Penal Code and under Section 27 of the Arms Act.
Informant has alleged that six persons, named in the FIR entered into the house of the informant and started firing due to which Bhikhari Sahani, the father of the informant, Rajkishore Prasad, Champa Devi and Mantun @ Aryan, the mother and nephew of the informant respectively, sustained firearm injuries and died. The ladies of the family of the informant and the family members of Ganesh Sahni saw the

It has been submitted on behalf of the petitioner that he is innocent and has been falsely implicated in this case due to personal grudge. He is not named in FIR. It has been further submitted that similarly placed co-accused persons have been granted bail by co-ordinate Bench of this Court vide order dated 17.05.2017 passed in Cr. Misc. No. 23237 of 2017, vide order dated 22.06.2017 passed in Cr. Misc. No. 20096 of 2017 and vide order dated 05.05.2017 passed in Cr. Misc. No. 19776 of 2017. He is in custody since 14.06.2018.
Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned Addtional Chief Judicial Magistrate, Motihari, East Champaran, in connection with Pakridayal P.S. Case No. 121 of 2016, with following conditions:- (1)Bailors should be local having sufficient immovable property within the jurisdiction of the court concerned.
(2) Petitioner shall co-operate in the trial and shall be properly represented on each and every date fixed by the court and shall remain physically present as directed by the Court and his absence on two consecutive dates without sufficient

(3) If the petitioner tampers with the evidence or the witnesses of the case, in that case, prosecution will be at liberty to move for cancellation of bail of the petitioner.
