Mr. APP ====================================================== CORAM: HONOURABLE MR. JUSTICE ASHUTOSH KUMAR ORAL ORDER 01-04-2022 Heard Mr. Manish Rai Sharma, the learned Advocate for the petitioners and the learned APP for the State.

The petitioners seek bail in anticipation of their arrest in connection with Thawe P.S. Case No. 135 of 2020, dated 28.07.2020, instituted for the offences under Sections

Patna High Court CR. MISC. No.19803 of 2021(2) dt.01-04-2022 2/3 341, 323, 324, 307, 504, 506 and 34 of the Indian Penal Code.

Both the petitioners are alleged to have assaulted the informant by means of a knife, which has resulted in simple injuries to him. The occurrence took place at the time when construction activity was going on over a disputed plot of land.

It has been urged on behalf of the petitioners that they are agnates and co-sharers of the informant. It has further been submitted that there is a Title Suit pending between the parties. It is on account of that dispute, that an occurrence might have taken place wherein both sides have received injuries.

There is a counter version of the occurrence also vide Thawe P.S. Case No. 155 of 2020.

Regard being had to the facts afore-stated, the petitioners, in the event of their arrest or surrender before the learned Court below within a period of four weeks, are directed to be released on bail on their furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) each

Patna High Court CR. MISC. No.19803 of 2021(2) dt.01-04-2022 3/3 with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gopalganj in connection with Thawe P.S. Case No. 135 of 2020, subject to the conditions laid down under Section 438(2) of the Cr.P.C. The application stands allowed.
