JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 05-05-2015 Heard learned counsel for the petitioner as well as leaned Additional Public Prosecutor for the State. The petitioner is not named in the first information report, particularly, in the circumstance, when the informant claimed himself to be eye witness of the alleged occurrence. The name of the petitioner surfaced in course of investigation, when the statement of family members of the informant were recorded and his family members claimed to have seen the petitioner running from the place of occurrence. Moreover, one FIR named accused namely, Pappu Yadav @ Umesh Yadav @ Umesh Kumar has already been admitted to anticipatory bail by a coordinate bench of this court vide order dated 03-07-2014 passed in Cr. Misc. No. 12614 of 2014.
Patna High Court Cr.Misc. No.49608 of 2014 (4) dt.05-05-2015 Accordingly, let the petitioner named above, be released on bail on furnishing bail bond of Rs 10,000/- (ten thousand) with two sureties of the like amount each in connection with Atri P.S. Case No. 176 of 2012 to the satisfaction of learned Chief Judicial Magistrate, Gaya.
