1. Heard learned counsel for the petitioner and learned APP for the State.
2. Petitioner seeks regular bail in connection with Shekhopur Sarai P.S. Case No. 139 of 2021 dated 03.09.2021 registered for the offences punishable under Sections 419, 420, 467, 468, 471, 120(B) and 34 of the Indian Penal Code.
3. The main submissions advanced by petitioner's counsel are that in the present matter there is no allegation against the petitioner and his name came into light in the statement of co-accused Shambhu Paswan and as per the statement of the said co-accused, petitioner allegedly provides data of various persons and on the basis of such data co-accused

No.10223 of 2023(2) dt.04-05-2023 2/3 persons used to make spam calls to the innocent people and cheat them but except this there is no any other allegation against the petitioner and one co-accused person namely, Dheeraj Paswan has been granted bail by a co-ordinate Bench of this Court vide order passed in Cr. Misc. No.53733 of 2022 and from the possession of this petitioner nothing incriminating has been recovered and he has been languishing in jail since 15.11.2022 and he was not arrested at the place of occurrence and several persons have been made accused in this case.
4. Learned APP appearing for the State has opposed the prayer for bail.

Considering the above submissions and mainly the facts that above-mentioned co-accused person has been granted bail and as per above submission, from the possession of this petitioner no incriminating material has been recovered and against him the investigation has been completed and his case appears to be identical to the co-accused person who is on bail, in my opinion it is a fit case for bail to the petitioner. Accordingly, let the petitioner named-above be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the concerned Court in connection with Shekhopur Sarai P.S. Case
