1. Heard learned counsel for the petitioner and the learned APP for the State.

2. Petitioner seeks regular bail in connection with Begusarai Muffasil P.S. Case No. 695 of 2023 dated 26.11.2023 registered for the offence punishable under Section 392 of the Indian Penal Code and later on, Section 411 of IPC was added.

3. The main submissions advanced by the learned counsel for the petitioner are that the petitioner is not named in the FIR and during the course of investigation, his name surfaced in the present matter on the basis of confessional statement of co-accused Raj Kumar and a dispute is running in between the petitioner's family and the family of the said coaccused and due to this reason, the petitioner has been dragged

Further submissions are that no incriminating or looted articles were recovered from the possession of the petitioner and he has been implicated in the present matter merely on suspicion and he is a labourer having fair and clean antecedent and has been languishing in jail since 27.11.2023 and he was not put on Test Identification Parade.

4. Learned APP appearing for the State has opposed the bail prayer.

5. Considering the above submissions and mainly taking into account the petitioner's fair and clean antecedent coupled with the nature of incriminating materials against the petitioner upon which the prosecution is relying, in my opinion, the petitioner deserves to a lenient approach of this Court. Accordingly, let the petitioner named-above be released on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the concerned Court in connection with Begusarai Muffasil P.S. Case No. 695 of 2023.
