JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 10-04-2019 This petition has been filed for modification in order dated 20.09.2018 passed in Cr. Misc. No. 57253 of 2018 by which petitioner was granted privilege of anticipatory bail with direction to surrender before the trial court within four weeks from the date of receipt/ production of a copy of the aforesaid order in the concerned court.
Learned counsel appearing for the petitioner submits that the petitioner had gone outside the state in connection with his livelihood and when he returned to his home, he learnt about the order dated 20.09.2018 passed in Cr. Misc. No. 57253 of 2018.
Since the time for surrender had already expired,
Patna High Court CR. MISC. No.22325 of 2019(2) dt.10-04-2019 2/2 petitioner could not surrender before the trial court and has filed this petition for extension of time for surrender. In view of the aforesaid facts and circumstances, this petition stands disposed of extending the period of surrender for further six weeks from today and, accordingly, petitioner is directed to surrender before the learned Additional Sessions Judge-II-cum-Special Judge, Excise, Rohtas at Sasaram in connection with Suryapura P. S. Case No. 17 of 2017. It is made clear that if the petitioner does so, the concerned court shall pass appropriate order in the light of order dated 20.09.2018 passed in Cr. Misc. No. 57253 of 2018. In the aforesaid manner, order dated 20.09.2018 passed in Cr. Misc. No. 57253 of 2018 stands modified to the above stated extent.
