The petitioner seeks bail in connection with Bela P.S. Case No. 237 of 2021 instituted for the offences under Sections 30(a), of the Bihar Prohibition & Excise Act, 2016, Learned counsel for the petitioner submits that the petitioner is in custody since 16.12.2021, is a person of clean antecedent, charge-sheet has been submitted in the case and allegation is of recovery of 117 liters of liquor from a luggage. Learned counsel for the petitioner submits that the petitioner has been falsely implicated the real culprit leaving the luggage on seeing the S.S.B Team and the luggage does not belong to the petitioner.

Learned A.P.P. for the State vehemently opposes the

Patna High Court CR. MISC. No.9125 of 2022(2) dt.10-03-2022 2/2 prayer for bail of the petitioner.

Considering the fact that the petitioner is in custody since 16.12.2021, charge-sheet has been submitted in the case and is a person of clean antecedent, let the petitioner above named be released on bail on furnishing bail bond of Rs. 2000/- (Rupees Two Thousand) with two sureties of the like amount each to the satisfaction of learned ADJ- II cum Special Judge Excise Act, Sitamarhi in connection with Bela P.S. Case No. 237 of 2021.
