2. The petitioner seeks bail in Atri P.S. case No. 296 of 2018 instituted for the offences under Sections 147, 149, 341, 302, 342, 307, 323 of the Indian Penal Code.
3. Prosecution allegation, in short, is that while the brother of the informant was on the way, the accused persons including the petitioner assaulted the brother of the informant due to which he sustained injury. It is further alleged that Baliram Manjhi, Jagnarayan Manjhi and Harichand Manjhi assaulted the brother of the informant.
4. Learned counsel for the petitioner submits that
Patna High Court CR. MISC. No.15772 of 2024(2) dt.13-03-2024 2/3 the petitioner is innocent and has falsely been implicated in the present case. General and omnibus allegation has been made against the petitioner. No specific overt act is alleged against the petitioner. Specific allegation of assault is alleged against co-accused namely Baliram Manjhi, Jagnarayan Manjhi and Harichand Manjhi. The petitioner is alleged to be member of mob. Charge-sheet has been submitted in this case. The petitioner is in custody since 11.08.2023 and has no criminal antecedent. Similar coaccused have been granted bail by a Coordinate Bench of this Court vide Annexure-2 to this application.
5. Learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioner.
6. Considering the aforesaid facts and circumstances of the case, the period of custody undergone by the petitioner and the claim based on parity, this Court is inclined to grant bail to the petitioner.
7. Let the petitioner be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Court below/concerned Court in connection with Atri P.S.
