This application under Article 227 of the Constitution of India has been filed by the petitioner for quashing the order dated 06.12.2018 passed by the learned SubJudge-IV, Samastipur in Title Suit No. 167 of 2007 rejecting the petition dated 26.10.2018 filed by the petitioner (defendant no.

1) to declare the report dated 27.08.2018 with respect to

Patna High Court C.Misc. No.204 of 2019(2) dt.04-04-2019 2/2 comparison of hand writings on Ext. B and 2 illegal. After some arguments, learned counsel for the petitioner sought leave to withdraw the present application. Learned counsel for the respondent no. 1 does not oppose the prayer of withdrawal.
