Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner seeks bail in a case registered under Sections 144 and 436 of the Indian Penal Code. It has been submitted on behalf of the petitioner that as per the allegation he was member of the mob and was involved in lighting part of the house of the informant. However, several accused persons have been acquitted of the charges by the trial court, a copy of one of such judgments has been appended as Annexure 2. Petitioner was arrested on 24.03.2014 and since then he is in custody.

No.50586 of 2014 (3) dt.04-03-2015 2 / 2 Having regard to the facts and the circumstances of the case, the petitioner, Bipat Bhuiyan is directed to be released on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Ad hoc Addl. Sessions Judge IV, Aurangabad in connection with Deo P.S. Case No.9 of 1982, S.Tr. No.233A/2004 / 37/14. However, if the petitioner fails to remain present on two consecutive dates during the course of the trial without any reasonable cause being shown, the court concerned would be at liberty to take steps for cancellation of his bail bonds.
