The petitioners seek bail in anticipation of their arrest in connection with Mahesi P.S. Case No. 279 of 2020 instituted for the offence under Sections 147, 149, 341,
Patna High Court CR. MISC. No.19399 of 2021(2) dt.25-03-2022 2/2 323, 325, 307, 354, 448 and 379 of the Indian Penal Code. Though the petitioners are specifically alleged to have taken part in the assault but there is a counter version of the occurrence also and a Title Suit is pending between the parties. The injuries suffered by the informant and others are stated to be simple in nature.
Considering the afore-stated facts, the petitioners, above named, are directed to be released on bail, in the event of their arrest or surrender before the court below within a period of eight weeks from the date of receipt / production of a copy of this order, on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Motihari, East Champaran, in connection with Mahesi P.S. Case No. 279 of 2020, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
