1. Heard learned counsel for the petitioner as well as learned APP for the State.

2. The petitioner seeks bail in anticipation of his arrest in a case registered for the offences punishable under Sections 147, 149, 341, 323, 302, 307 of the IPC and 3⁄4 Dian Act.

3. The learned counsel for the petitioner submits that petitioner is a person with clean antecedent from perusal of the allegation as alleged in the FIR, it would manifest that on 29.07.2020 at about 06:00 PM when the mother-in-law of the informant was returning home after planting paddy, when all the FIR named accused persons including the petitioner called her witch and thereafter assaulted her by means of lathi and danda as a result of which she died.

4. Learned counsel for the petitioner submits that the

Patna High Court CR. MISC. No.11027 of 2024(2) dt.06-03-2024 2/2 allegations are general and omnibus in nature and nothing specific has been alleged against the petitioner. It is also submitted that there are no eyewitness to the occurrence and only on the basis of suspicion the petitioner has been implicated.

5. The learned APP opposes the anticipatory bail application.

6. Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, in the event of his arrest or surrender before the learned Court below within a period of six weeks, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate,IInd, Gaya in connection with Belaganj P.S. Case No.226 of 2020, subject to the conditions laid down under Section 438(2) of the Cr.P.C.

7. The application stands allowed.
