Petitioner apprehends arrest in a case registered for the offences punishable under Sections 302, 120(B), 379/34 of the Indian Penal Code.

Allegation against the petitioner and other co-accused persons is that they assaulted the brother of the informant by bricks due to which he succumbed to injuries. Learned counsel appearing for the petitioner submits that in this case, informant claims to be an eye witness of the occurrence and as per F.I.R., all the named accused persons committed the alleged occurrence. Petitioner is not named in the F.I.R. His name transpired during course of investigation. Petitioner has got clean antecedent.

No.11404 of 2023(2) dt.28-04-2023 2/2 Considering the aforesaid facts and circumstances, let the above named petitioner in the event of his arrest/surrender before the court below within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-4th, Jamui in connection with Chandramandih P. S. Case No. 56 of 2022, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
