1. Heard learned counsel for the parties.
2. The petitioner has preferred this application for grant of regular bail in connection with Sessions Case no.430 of 2025, arising out of Harinmar P.S. Case no.17 of 2025 registered under sections 191(1), 191(2), 191(3), 115(2) and 109 of the Bhartiya Nyaya Sanhita, 2023 and section 27 of the Arms Act to which section 103(2) of the Bhartiya Nyaya Sanhita, 2023 was added subsequently.
3. As per the prosecution case, the informant states that while his sons were returning home, the four named accused persons including the petitioner herein as also 2-3 unknown accused persons, on the point of arms, started to assault them. It is further stated that his son was assaulted by
Patna High Court CR. MISC. No.8236 of 2026(2) dt.17-02-2026 2/3 Prakash Singh @ Bhayankar Singh as a result of which he sustained internal injuries for which he was being treated by a doctor in Begusarai and as such the delay in lodging of the FIR.
4. Learned counsel for the petitioner submits that the injured son of the informant having died in course of treatment 21 days later, section 103 of the Bhartiya Nyaya Sanhita, 2023 was added. It is further submitted that there is a delay of 10 days in lodging of the FIR and accepting the allegations in the FIR, the allegation of assault on the son of the informant is on Prakash Singh. So far as the petitioner and others are concerned, the allegations are general and omnibus in nature. The petitioner is in custody since 1.9.2025 and chargesheet has been submitted in the case.
5. The application for bail is opposed by learned A.P.P for the State.

Having heard learned counsel for the parties and taking into consideration the allegations in the FIR, the specific allegation of assault on the deceased son of the informant being on Prakash Singh, the allegations on petitioner and others being general and omnibus in nature, the petitioner having remained in custody for 5 months since 1.9.2025 and chargesheet having been submitted in the case, the petitioner is directed to be
