JUSTICE SATYAVRAT VERMA ORAL ORDER 15-11-2021 Heard learned counsel appearing for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in connection with K. Nagar P. S. Case No.09 of 2021/ Special Excise Case No.26 of 2021 registered for the offences punishable under Sections 272, 273 of the I.P.C. and Sectionn 30(a) of the Bihar Prohibition and Excise Act, 2016.

From bare perusal of the allegation as alleged in the F.I.R., it would manifest that about 10 litres of Indian made foreign liquor is said to have been recovered from the Courtyard of the joint property of the petitioner.

Learned counsel for the petitioner submits that the liquor has not been recovered from the conscious possession of the petitioner. Petitioner is in custody since 09.01.2021.

Patna High Court CR. MISC. No.19680 of 2021(2) dt.15-11-2021 2/2 Learned A.P.P. opposes the prayer.

Considering the aforesaid facts and circumstances of the case as well as clean antecedent of the petitioner, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise, Purnea in connection with K. Nagar P. S. Case No.09 of 2021/ Special Excise Case No.26 of 2021.
