JUSTICE SUDHIR SINGH ORAL ORDER 16-10-2015 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted under Sections 363 and 366A of the Indian Penal Code and 12, 17 and 18 of the POSCO Act.

Allegation against the petitioner is that he along with his associates enticed away sister-in-law of the informant, kept her in a house and tried to get her married with an elderly man. It has been submitted on behalf of the petitioner that he has got no criminal antecedent. He is in custody since 16.4.2015. Chargesheet has been submitted. There is no allegation of tampering of evidence against the petitioner. He has been made accused due to mistake of fact. The victim girl in her statement recorded under Section 164 of the Code of Criminal Procedure has not made any allegation regarding she being harassed or being assaulted by this petitioner. Only allegation is that petitioner got her married to an elderly man. Petitioner denied the aforesaid allegation. It is further submitted that petitioner may be released

Considering the aforesaid facts and circumstances, let the above named petitioner be released on bail after completion of nine months in custody from 16.4.2015 on furnishing bail bond of Rs. 10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned Special Judge, POSCO, Muzaffarpur, in connection with Sakra P.S.
