Deceased, Soni Devi had filed written report divulging the fact that on 04.07.2009, Manoj Singh (petitioner) Surya Mani Devi, Pawan Singh, Dezy Devi caught hold her, sprinkled kerosene oil and then, lit fire. It is also apparent that during course of investigation, she died.

The police after concluding investigation, did not forward petitioner along with other F.I.R. named accused for trial and instead thereof, had submitted chargesheet under Section 309 of the I.P.C. against the informant/ deceased Soni Devi, Karu Singh and Niraj Singh. It is evident from Annexure-4, the order of cognizance dated 10.12.2009, that cognizance was taken for an offence punishable under Section 306/ 120B of the I.P.C. against

Patna High Court Cr.Misc. No.49814 of 2014 (03) dt.01-04-2015 six accused persons including the petitioner. It is also found that said co-accused had already been granted bail by different Cr. Misc. numbers at an earlier occasion. Petitioner happens to be under custody since 22.09.2014.

Consequent thereupon, petitioner Manoj Singh is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Mr. A. Kumar, Judicial Magistrate, 1st Class, Barh, Patna/ successor in office in connection with Mokamah P. S. Case no.117 of 2009.
