JUSTICE SUDHIR SINGH ORAL ORDER 30-04-2019 Heard learned counsel for the petitioner, learned APP for the State and learned counsel for the informant. The petitioner seeks bail in a case registered under Sections 302/34 of the Indian Penal Code.

Allegation is that the accused persons assaulted the mother of the informant by brick bat. Petitioner assaulted her by brick on her mouth. Accused Rizwan Sah and Irfan Sah threw brick, which hit on her chest, due to which she became unconscious and died.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 11.07.2018 and has got no criminal antecedent. Charge sheet has been submitted in this case. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is alleged to have caused

As per postmortem report, the deceased is said to have died due to injury caused on her chest. The allegation of causing injury on the chest is against co-accused Irfan Sah and Rijwan Sah. On behalf of the State and learned counsel for the informant, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Sri Ram Dubey, J.M. 1st class, Madhubani in connection with Kaluahi P.S. case No.117 of 2018.
