The petitioner seeks bail in a case registered for the offence under Sections 411, 413, 414/34 of the I.P.C. and Sections 8(c)/21(b)/27 of the N.D.P.S. Act.
One stolen tab and one stolen mobile phone have been recovered from the possession of the petitioner. It is submitted on behalf of petitioner that no contraband article has been recovered from the possession of this petitioner, rather 39 pouches of Smack has been shown to be recovered from the possession of co-accused Chandan Kumar. It is further submitted that the alleged mobile phone and tab belongs to petitioner himself. Though, in the impugned order, petitioner is stated to be involved in one more case, but it is error of record and petitioner has got clean antecedent. Petitioner is in custody since 20.10.2021. Considering the aforesaid facts and circumstances, the bail petition of petitioner is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge (NDPS Act), Patna in connection with Shastri Nagar P.S. Case No. 510 of 2021 (Special Case No. 153 of 2021).
