The petitioner is apprehending his arrest in connection with Mairwa P.S. Case No. 384 of 2018, registered for the offences punishable under Sections 272, 273, 308, 34 of the Indian Penal Code and Sections 30(a), 38(1), 41(1) of Bihar Prohibition and Excise Act, 2016.

Huge quantity of illicit liquor was recovered and the allegation is that petitioner and others are involved in the business of liquor. Petitioner has made accused in Nautan P.S. Case No.194 of 2018 registered on 5.10.2018 with another police station having identical allegation. Though the another case is subsequent matter to the present FIR, however, considering the nature of allegation, I am not inclined to grant

Patna High Court Cr.Misc. No.10533 of 2019(2) dt.25-02-2019 2/2 anticipatory bail to the petitioner. Hence, the prayer for anticipatory bail is refused.
