JUSTICE VIKASH JAIN ORAL JUDGMENT Date: 09-10-2017 The present petition has been filed for transfer of Matrimonial Case No. 767 of 2015 from the court of learned Principal Judge, Family Court, Patna to the court of learned Principal Judge, Family Court, Gaya.

2. At the very outset, learned counsel for the opposite party appears and undertakes that the subject Matrimonial Case No. 767 of 2015 would be withdrawn latest by the end of November, 2017. It is further undertaken that no step would be taken by the opposite party in the said Matrimonial Case in the meantime.

3. Having regard to the stand of the opposite party, the present petition stands disposed of with an observation that the petitioner shall be at liberty, in the event of failure on the part of the opposite party, to withdraw the said Matrimonial Case No. 767 of 2015

Patna High Court MJC No.2983 of 2016 dt.09-10-2017 2/2 by the end of November, 2017, to move for revival of the present petition.
