2. The petitioners are in custody in connection with Gaurichak P.S. Case No. 794 of 2022 registered for an offence punishable under Sections 302 and 120(B)/34 of the Indian Penal Code and Section 27 of the Arms Act.

3. As per prosecution case, all the accused persons are alleged to have shot the informant's son dead.

4. Learned counsel for the petitioners submits that petitioners have falsely been implicated in this case due to previous enmity and panchayat election. He submits that no specific allegation have been levelled against the petitioners. Petitioners

Patna High Court CR. MISC. No.11952 of 2024(2) dt.05-03-2024 2/2 are in custody since 04.09.2023. He next submits that similarly situated co-accused has already been granted bail by a Co-ordinate Bench of this Court passed in Cr. Misc. No. 43081 of 2023.

5. Learned APP for the State opposes the prayer for bail of the petitioner.

6. Considering the aforesaid facts, let the above named petitioners be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Sub Judge-cumACJM-VI, Patna City in connection with Gaurichak P.S. Case No. 794 of 2022, P.T. No.4753 of 2022.
