Mr. Nand Kishore Prasad, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 02-11-2022 Heard learned counsel for the petitioner, learned APP for the State and perused the case diary.

The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 147, 149, 341, 323, 337, 307 and 504 of the Indian Penal Code. Allegation against the petitioner is of assault upon the informant and his son by means of lathi, rod and bricks. It is submitted by learned counsel for the petitioner that the petitioner has falsely been implicated in this case. He further submits that the specific allegation of assault is against the other co-accused persons. There is case and counter case between the parties. Petitioner has clean antecedent. Learned APP appearing for the State has opposed the prayer for anticipatory bail and submitted that from perusal

Patna High Court CR. MISC. No.9044 of 2022(3) dt.02-11-2022 2/2 of the case diary, it appears that the injury report of the informant is not annexed with the case diary whereas the injury report in respect of the informant's son is annexed, showing the injuries grievous in nature.

Considering the aforesaid submissions, let the petitioner, above named in the event of their arrest or surrender before the court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned SDJM, Dehri, Rohtas in connection with Dehri (Town) P.S. Case No. 717 of 2019, G.R. No.1154 of 2019, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
