The petitioner apprehends his arrest in Vidyapati Nagar P.S. Case No.62 of 2021, registered for the offences punishable under Sections 147, 148, 149, 307, 323, 341, 354, 379, 504, 506 of the Indian Penal Code and Section 27 of the Arms Act.

Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in the present case. There is case and counter case between the parties and both sides are agnates. There is land dispute between the parties. It is further submitted that the petitioner is said to have fired upon the devar of the informant but fortunately the devar of the informant did not receive any injury. It is lastly submitted

Patna High Court CR. MISC. No.9220 of 2022(2) dt.02-08-2022 2/2 that the petitioner has got no criminal antecedent. The learned APP for the State opposed the prayer for anticipatory bail of the petitioner.

Taking into consideration the facts and circumstances of the case, let petitioner, above named, in the event of his arrest or surrender before the learned court below within a period of six weeks from today, be enlarged on bail on furnishing bail bond of Rs.25,000/- (rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-3rd, Dalsinghsarai, District Samastipur in connection with Vidyapati Nagar P.S. Case No.62 of 2021, subject to the conditions laid down under Section 438(2) of the Code of Criminal Procedure.
