Petitioner, who was engaged as a labourer committed sodomy upon a mentally retarded disabled victim aged about 13 years.

It has been submitted on behalf of petitioner that now-a-days such action is permissible not only nationally rather internationally and being so, taking into account the period of detention, petitioner be enlarged on bail.

Though, there happens to be some sort of activity on that very score, but not with mentally retarded and disabled person.
