JUSTICE VINOD KUMAR SINHA ORAL ORDER 22-04-2019 This application, for grant of anticipatory bail, arises out of C-III-213/18, disclosing offences under Sections 30(a) of the Bihar Prohibition and Excise Act, 2016.
Allegation is of recovery of 212.760 litres of liquor from in front of the house of co-accused and petitioner is said to have succeeded in fleeing away. Apart from that it appears that petitioner is an accused in three more cases of similar nature. Submission of learned counsel for the petitioner is the from the F.I.R. itself it is evident nothing has been recovered either from the house of the petitioner or from his instance and he has falsely been made accused in this case. Heard learned A.P.P. also.
Having heard both sides, considering the facts and

No.8406 of 2019(3) dt.22-04-2019 2/2 circumstances of the case as well as the fact that petitioner is an accused in three more cases of similar nature, I am not inclined to grant the privilege of anticipatory bail to the petitioner rather petitioner should surrender before the court below and make prayer for regular bail and if any such application is filed, the court below will dispose of the same on the merit of the case, without being prejudiced by this order.
