The petitioner being the husband of the victim daughter of the informant has renewed his prayer for bail in a case registered for the offences punishable under Sections 304B and 201/34 of the Indian Penal Code.

The accusation is of killing the daughter of the informant after six years of the marriage for non-fulfillment of the dowry demand.

It is submitted by learned counsel for the petitioner that the victim died due to pregnancy complication. A report was called for from learned trial court. The report of learned Additional Sessions Judge-VII,

Patna High Court Cr.Misc. No.54295 of 2015 (3) dt.29-06-2016 2/2 Danapur, Patna dated 28.03.2016 reflects that the mater is still fixed for appearance of the accused and there is no likelihood of conclusion of the trial. The report of the learned trial court suggests the casual manner in which the trial court is conducting the trial.

Since the death took place after six years of the marriage, the petitioner is languishing in custody since 01.12.2013 and there is no likelihood of conclusion of the trial in near future, let the above named petitioner, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-VII, Danapur, District - Patna in connection with Sessions Trial No. 775 of 2015 arising out of Paliganj P.S. Case No. 324 of 2013.

The learned court below will be at liberty to cancel the bail bonds of the petitioner, if he defaults for two consecutive occasions.
