JUSTICE PRABHAT KUMAR JHA ORAL ORDER 14-12-2015 Heard both sides. The petitioner apprehends his arrest in a case registered for the offences under sections 379 and 411 of the Indian Penal Code.
Learned counsel for the petitioner submits that the petitioner is not named in the F.I.R. The true fact is that the petitioner purchased the Dala on payment of Rs.21,000/-, and some money was due against the petitioner, but the informant has made allegation of theft against the petitioner. It appears from the perusal of the seizure list that the Dala was found tied with the Tractor of the petitioner and the same was recovered. Considering the aforesaid facts, I am not inclined to enlarge the petitioner on anticipatory bail in connection with
Patna High Court Cr.Misc. No.51253 of 2015 (2) dt.14-12-2015 2/2 Korma P.S. Case No. 40/15, pending in the court of Sri R.R. Singh, Judicial Magistrate, 1st Class, Sheikhpura. The application is rejected.
