JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 17-02-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. The trial court has reported that charge has already been framed and the case is pending for recording the prosecution evidence. It appears from the report of the trial court that not a single prosecution witness could be examined by the prosecution, particularly, in the circumstance when the petitioner is in jail custody since 28.4.2014. Moreover, the trial court is directed to conclude the trial of the petitioner as early as possible preferably within six months from the date of receipt/production of a copy of this order.
Accordingly, the prayer for bail of the petitioner in connection with Sessions Trial No.236 of 2015 arising out of
Patna High Court Cr.Misc. No.56638 of 2015 (3) dt.17-02-2016 2/2 Athmalgola P.S. Case No.64 of 2014 stands rejected at least at this stage. However, petitioner may renew his prayer for bail if the trial of the petitioner is not concluded within the above stated period of six months.
