Heard the learned counsel for the parties.

The petitioner seeks bail in connection with Singhwara P.S. Case No. 190 of 2017, which was initially instituted for the offences under Sectgions 307, 323, 336, 341, 498(A) and 504/34 of the IPC but with the death of the deceased, Section 302 of the IPC was also added.

The prayer for bail of the petitioner was earlier rejected twice, once by the then coordinate Bench of this Court vide order dated 11.01.2019 passed in Cr. Misc. No. 55161 of 2018 and again by this Court vide order dated 17.08.2019 passed in Cr.

Patna High Court CR. MISC. No.14803 of 2023(4) dt.08-09-2023 2/3 Misc. No. 25736 of 2019.

The petitioner is the husband of the deceased. 5.

A report had been called for from the court below about the stage of trial. The report dated 17.07.2023 indicates that out of nine cited witnesses, seven have already been examined.

The learned counsel for the petitioner submits that all the seven witnesses, who have been examined in the Trial have not supported the case of prosecution and have been declared hostile. 7.

The petitioner is said to be in custody since 28.01.2018 8.

However, looking at the nature of allegation against the petitioner, I am not inclined to grant bail to him for the present.

The Trial Court is but directed to positively conclude the trial within next three months, to be counted from today, failing which, the petitioner shall have the liberty to approach this Court again for grant of bail.
