Petitioner apprehends his arrest in Masaudhi P.S. Case No.748 of 2018, corresponding to Special Case No.9819 of 2018, registered under Section 30(A) of the Bihar Prohibition Excise Amendment Act.

The informant raided the house of different persons and from the house of the petitioner, Sadhu Sao @ Sunil Kumar, 10 Kgs. Mahua flower is said to have been recovered. Learned counsel for the petitioner submits that the petitioner was not present in his house. Mahua flower is used for personal consumption by the family members. Nothing was found to show that the petitioner was preparing liquor from Mahua flower.

No.8775 of 2019(2) dt.14-02-2019 2/2 Taking into consideration the fact that only 10 Kgs. of Mahua flower is said to have been recovered as it appears from seizure list, let petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt of this order be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise, Patna in connection with Masaudhi P.S. Case No.748 of 2018, corresponding to Special Case No.9819 of 2018, subject to the conditions laid down under Section 438(2) Cr.P.C.
