JUSTICE SANJEEV PRAKASH SHARMA ORAL ORDER 20-04-2023 The petitioner, by way of this writ petition, has prayed as under:- "1. That this application is being filed for a direction upon the respondents to issue fresh bill of three phase LTIS connection of the petitioner after making fresh enquiry of the business premise of the petitioner

Patna High Court CWJC No.2723 of 2023(2) dt.20-04-2023 2/2 wherein the petitioner has installed 10 HP electrical motor but maximum demanded load of his machine and speller is only 7.5HP. Further for a direction upon the respondents to withdraw the amount of penalty imposed on the petitioner which has been calculated in most arbitrary manner without providing opportunity of hearing to the petitioner. And/or pass such other order/orders as your lordships may deem fit and proper in the facts and circumstances of this case."

Since, an alternative remedy is available to the petitioner to approach the Consumer Grievances Redressal Forum, formed under Section 42(5) of the Electricity Act, which is functioning in the State of Bihar, the petitioner is granted liberty to approach the said forum for redressal of his grievance. If such an application is moved, the concerned forum shall decide the same expeditiously within a period of thirty days of its filing.

3. Granting such liberty to the petitioner, the present application is dismissed.
