JUSTICE MOHIT KUMAR SHAH ORAL ORDER 07-04-2023 The present writ petition has been filed seeking the following relief:- "1. That this is an application for issuance of an appropriate Writ, Order or direction to the respondents concerned to restrain forthwith the work of establishing pumping set/Boring under the scheme of "Mukhayamantri Gramin Pay Jal Nischaya Yojana" by encroaching by force the ancestral land of the petitioner bearing Khata No. (Old)-19, Khesra No.

(Old)- 419/488, area 2 Katha located at Village- Majlishpur, Block- Bidupur, District-

Patna High Court CWJC No.19447 of 2016(2) dt.07-04-2023 2/2 Vaishali by Respondent No. 6 with the collusion of Respondent No. 4 in Ward No. 3 while Ward No. 5 and 10 has been recommended and selected by "Aam Sabha"

for establishing Boring and there the land of Bihar Govt. is available and the so called majority of Schedule Caste as per guidelines of this" Yojana" is also there and the petitioner further prays that the Boring be established in selected ward no., i.e. ward no. 5 and 10 and not in ward no. 3 on the ancestral land of the petitioner and the petitioner further prays to grant any other relief/reliefs as the Hon'ble Court may think fit and proper."

Considering the nature of relief sought for in the present writ petition, I deem it fit and proper to grant liberty to the petitioner to approach the Respondent Authorities for redressal of his subsisting grievances.

Accordingly, the present writ petition stands disposed off on the aforesaid terms.
