This is a petition for modification of order dated 15.09.2015 passed in Cr. Misc. No. 25394 of 2015 by which opposite party No.2, Ajit Kumar Mishra was granted bail. It is submitted that learned counsel for the informant was appearing in the aforesaid case and he requested learned counsel for the petitioner, Ajit Kumar Mishra, to take adjournment but he argued the case and on such Ajit Kumar Mishra was granted bail. It is prayed that let the order be modified and the bail petition be heard again.

It appears that the case was registered under section 420, 467 and other allied sections of the IPC alleging that Ajit Kumar Mishra illegally mutated his name with regard to land standing in the name of informant but on consideration of the case

Patna High Court Cr.Misc. No.51898 of 2015 (2) dt.27-04-2016 2/2 and the fact that petitioner, Ajit Kumar Mishra, was in jail for more than five months he was granted bail.

I do not find any reason to modify the order aforesaid and the petition for modification is dismissed. (Prabhat Kumar Jha, J) BKS/- U T
