Petitioners of both the applications are accused in connection with Budha Colony P.S. Case No. 230 of 2015 registered under Sections 420, 384/34 of the I.P.C. and 3(i) (x) of the S.C./S.T. (prevention of atrocities) Act. Therefore, both applications are being heard together and disposed of by this order.
The allegation of informant Om Prakash Diwakar is that he has been selected by the Bihar Police Selection Board and his Roll no. is 2851180495. On 13.09.2015, in the evening he
Patna High Court Cr.Misc. No.51378 of 2015 (3) dt.18-12-2015 2/2 received call through mobile no. 7057420912 on his mobile phone to the effect that he has been declared unfit in Medical Test and he was suggested to come with cash Rs. 15,000/- at Police Line so that he may be declared fit in Medical Examination. Similar information was received by the other candidates Devesh Kumar. They informed to the Police about the incident and thereafter, the Police came in action and arrested both the above petitioners at the time of hading over the money.
Learned counsel appearing on behalf of the petitioners submits that both the petitioners are Constable and have falsely been implicated in this case by other Police Personnel, who have grudge and enmity with the petitioners. It is also submitted that petitioners have no criminal antecedent and are in custody since 14.09.2015.
Having considered the facts and circumstances of the case, let the above named petitioners be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Judicial Magistrate, 1st Class, Patna in connection with Budha Colony P.S.
