JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 27-10-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Near about 49 kg. Ganja was said to have been recovered from pumping set of the petitioner and father of the petitioner was caught on the spot.

Admittedly, petitioner was neither caught on the spot nor anything was recovered from his conscious possession and petitioner's father disclosed before the police that petitioner was involved in smuggling of the Ganja.

Taking into consideration the above-said facts and circumstances as well as submission of the parties, particularly, taking note of this fact that the petitioner does not have any criminal antecedent, let the petitioner named above, be released on

Patna High Court Cr.Misc. No.29961 of 2015 (3) dt.27-10-2015 2/2 bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with N.D.P.S. Case No. 6B of 2014 arising out of Simari P.S. Case No. 73 of 2014 to the satisfaction of learned District Judge-cum-Special Judge, Buxar.
