JUSTICE VINOD KUMAR SINHA ORAL ORDER 03-03-2020 The petitioner seeks regular bail in connection with Chakand P.S. Case No. 151 of 2019, registered for offences punishable under Sections 30(a) of the Bihar Prohibition and Excise Act, 2016.

Allegation is of recovery of 47 litres of mahua liquor from the house of the petitioner. Apart from that he is accused in one more case.

It has been submitted on behalf of the petitioner that he has falsely been implicated in this case and the house from which the alleged recovery was made is a joint house and though he is accused in one more case but that is not under Excise Act. Further he has been in judicial custody since 06.12.2020.

Heard learned A.P.P. also.

No.8993 of 2020(2) dt.03-03-2020 2/2 Having heard both sides, in view of the above facts, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Special Excise Judge, Gaya in connection with Chakand P.S. Case No. 151 of 2019.
