1. Heard learned counsel for the petitioner, the learned counsel appearing on behalf of the informant and learned APP for the State.
2. The petitioner seeks bail in anticipation of his arrest in a case registered for the offences punishable under Sections 498(A), 406 of the Indian Penal Code and Sections 3 and 4 of the D. P. Act.
3. The learned counsel for the petitioner submits that the case was referred for mediation and the mediation proceeding was successful and the petitioner and the opposite party no.2 are leading a happy and peaceful conjugal life.
4. The learned counsel appearing on behalf of the
Patna High Court CR. MISC. No.11949 of 2024(3) dt.23-07-2024 2/2 opposite party no.2 also does not oppose the said submission of the learned counsel appearing on behalf of the petitioner.
5. Considering the submissions made by the learned counsel for the petitioner, the petitioner, above-named, in the event of his arrest or surrender before the learned Court below within a period of six weeks, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 5,000/- (Rupees Five Thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-Divisional Judicial Magistrate, Saharsa in connection with Sasaram Nagar P. S. Case No.532 of 2022, subject to the conditions laid down under Section 438(2) of the Cr.P.C.
6. The application stands allowed.
