JUSTICE MOHIT KUMAR SHAH ORAL ORDER 09-09-2022 Though the present writ petition has been filed for removal of encroachment from the public road situated over Khata No. 325, Plot No. 251, Area 0-3/4 decimal land situated in village-Khajuri, P.S. Kuchaykot, District-Gopalganj, however, it is submitted that the Circle Officer, Kuchaykot, District-Gopalganj has already issued notice to the encroachers in the year 2018 itself to remove the encroachment, however, till date no effective steps have been taken for removal of the encroachment in question.

In such view of the matter, I deem it fit and proper to

Patna High Court CWJC No.5936 of 2021(2) dt.09-09-2022 2/2 dispose off the present writ petition with a direction to the Circle Officer, Kuchaykot, District-Gopalganj to take appropriate action for removal of the encroachment in question in accordance with the provisions contained under the Bihar Public Land Encroachment Act, 1956 and after hearing the affected parties, within a period of 12 weeks of receipt/production of a copy of this Order.

Accordingly, the present writ petition stands disposed off on the aforesaid terms.
