JUSTICE MOHIT KUMAR SHAH ORAL ORDER 17-10-2022 The present writ petition has been filed seeking the following relief :- "For issuance of appropriate order/ orders, direction/ directions, writ/ writs, preferably in the nature of mandamus, commanding and directing the respondent authority concerned, to allot the government land appertaining to Taujee no. 1689, Khata no. 322, Survey no.

2698, Thana no. 348, Area 0-19 decimal of Mauza-Maghar, PO Sagharsultanpur, Block+PS- Bhagwanpur Hat, District- Siwan in favour of petitioner for constructing his house for which he has already been submitted his application before the District Collector, Siwan on 19th December, 2001 being a defence

Patna High Court CWJC No.5981 of 2021(2) dt.17-10-2022 2/2 personnel in the light of letter of Ministry of Defence dated 15th June, 1964 as well as letter of Army Headquarters dated 28th July, 1964 and a recommendation in this regard has already been issued from the level of Commanding Officer, INS Kuthar, Visakhapatnam-14 addresed to the District Collector, Siwan on 19th December, 2001 itself but uptill now no land has been allotted to the petitioner. "

At the outset the learned counsel for the petitioner seeks liberty on behalf of the petitioner to approach the District Magistrate, Siwan for redressal of his aforesaid grievance. Liberty so sought, is granted.

It is needless to state that in case, appropriate representation is filed within a period of four weeks from today, before the District Magistrate, Siwan, the same shall be considered, in accordance with law and appropriate decision shall be taken within a period of 12 weeks, thereafter. The writ petition stands disposed off on the aforesaid terms.
