JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 25-04-2023 Heard learned counsel for the petitioner and the State. Petitioner apprehends arrest in a case registered for the offence punishable under Sections 353, 354(A), 379, 504 and 506 of the Indian Penal Code.

It is alleged that the on 11.11.2016, petitioner Sona Devi came to Center at P.N.B and gave informant old currency notes of Rs.18,000/- to deposit in her account. She got the same deposited and her passbook was also updated. On 24.11.2016, petitioners Sona Devi and Ranjeet Chaudhary altercated with informant and thereafter began to harass her by indecent conduct. It is further alleged that petitioner Surendra Yeadav once caught her with malafide intention and snatched away her purse containing Rs.2,000/- and other papers of the bank. Patna High Court CR. MISC. No.9418 of 2023(2) dt.25-04-2023 2/2 has falsely been implicated in this case and no occurrence as alleged in the FIR has taken place. No case of Sections 353, 354(A) and 379 of I.P.C. is made out against the petitioner in this case. The present case is counter blast of Neemchak Bathani P.S. Case No. 146 of 2016 lodged by the petitioner. Learned counsel for the State opposes the bail petition of the petitioner.

Considering the aforesaid facts and circumstances of the case, in the event of arrest or surrender within six weeks from today, let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-X, Gaya in Neemchak Bathani P.S. Case No.150 of 2016 subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
