The instant application for anticipatory bail has been filed by the petitioner apprehending his arrest in connection with Belhar P.S. Case no. 134 of 2021 instituted for the offence under Sections 366(A) of the Indian Penal Code. It is a case of abduction of minor daughter of the informant by the petitioner for marriage purpose. Learned counsel appearing on behalf of the petitioner has submitted that petitioner is innocent and has committed no offence. In fact, daughter of the informant was in love with the petitioner. The allegation levelled against the petitioner is false and fabricated.

Patna High Court CR. MISC. No.9369 of 2022(2) dt.10-08-2022 2/2 appearing for the State has opposed the prayer of bail and submitted that statement of the victim girl has got been recorded under Section 164 Cr.P.C., wherein she has made direct allegation of abduction against the petitioner. She has further alleged that petitioner had taken away her to Sultanganj and thereafter to Delhi and solemnized marriage with her forcefully.
Having heard learned counsel for the parties and taking into consideration that there is direct allegation against the petitioner of abduction and solemnizing marriage with the minor daughter of the informant, I am not inclined to grant bail to the petitioner and, as such, his application for bail stands rejected.
