JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 30-01-2016 Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner seeks bail in connection with Singheshwar P.S.Case No.125 of 2015 registered under Section 392 of the Indian Penal Code.

It is contended that the case was registered against unknown and name of the petitioner transpired during investigation on the basis of confession made by a co-accused. It is also contended that though the petitioner is in custody since 28.1.2015, he has not been put on test identification parade till date and no incriminating article has been recovered from his possession.

Patna High Court Cr.Misc. No.52357 of 2015 (3) dt.30-01-2016 2/2 Learned counsel for the State has contended that the petitioner is a habitual offender. He has been made accused in ten other cases of identical nature. There are sufficient materials in the case diary to show his involvement in the present occurrence. Be that as it may, regard being had to the long standing criminal history of the petitioner, I am not inclined to grant bail to the petitioner. Accordingly, his prayer for bail is rejected. The court below is directed to expedite the trial and conclude the same as early as possible.
