Petitioner is not named in the first information report but in course of investigation, name of the petitioner surfaced in this case on the ground that he was last seen with deceased. Moreover, after due investigation, police submitted charge sheet for the offence punishable under section 304 of the Indian Penal Code.

Accordingly, petitioner is directed to be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Addl. Chief Judicial Magistrate, Nalanda at Biharsharif in Chhabilapur P.S. Case no. 36/2015. shahid (Hemant Kumar Srivastava,J) U T
