BAJANTHRI) 11-10-2023 The present M.J.C. petition is filed for noncomplinace of the orders of this Court dated 08.01.2020 passed in C.W.J.C. No. 118 of 2020.
2. Grievance of the petitioner is relating to certain encroachments. In this regard, this Court has directed the petitioner to submit a representation. Accordingly, petitioner had submitted representation dated 27.02.2020. Thereafter, the concerned authority was required to examine the petitioner's representation within a period of three months from the date of
Patna High Court MJC No.713 of 2021(4) dt.11-10-2023 2/2 receipt of the order dated 08.01.2020. However, there is delay in complying the orders of this Court read with the contents of the petitioner's representation.
3. The orders of this Court has been complied on 06.05.2023, whereas, the reasons assigned for delay is that Covid-19 pandemic was in vogue from March, 2020 till March, 2022. In the meantime, encroachment proceedings have been initiated in the year 2021 and it has been completed in the year 2023.
4. Taking note of these facts and circumstances, the present M.J.C./Contempt Petition stands dropped reserving liberty to the petitioner to assail the order dated 06.05.2023 or any other order in an independent writ petition. (P. B. Bajanthri, J) ( Arun Kumar Jha, J) manish/- U
