2. The petitioner seeks bail in connection with Rail Jhajha P.S. Case No. 266 of 2023 registered for the offence punishable under Sections 8, 20(b)(ii) (B) of the N.D.P.S. Act.

3. As per the prosecution case, 6 Kg. of ganja has been recovered from the bag which belongs to the petitioner.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case. Nothing has been recovered from the conscious possession of the petitioner. The petitioner has been implicated in this case merely on suspicion. The petitioner is in custody since 06.11.2023.

5. Learned APP appearing for the State opposes the

Patna High Court CR. MISC. No.12530 of 2025(3) dt.13-05-2025 2/2 prayer for regular bail of the petitioner.

6. Considering the recovery of intermediate quality of ganja and the custody, this application is allowed.

7. Let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-III, Jamui in connection with Rail Jhajha P.S. Case No. 266 of 2023, subject to the condition that both the bailors should be the close relative of the petitioner.

8. The petitioner will also mark attendance in Raghopur Police Station, District- Vaishali on first and third Sunday of each month. Any default in appearance at the Police Station would be result in cancellation of bail bonds of the petitioner.
